Goodwill Industries of Orange County, CA Sweepstakes Official Rules

NO PURCHASE OR PAYMENT OR STORE VISIT IS NECESSARY TO ENTER OR CLAIM PRIZE. A purchase will not improve the entrant’s chances of winning.

Eligibility: This Goodwill of Orange County Sweepstakes (the “Sweepstakes”) is open to anyone who (i) is a legal U.S. resident (ii) is at least eighteen (18), years of age.

Employees of Goodwill (“Sponsor”), and its parent companies, subsidiaries, affiliates, suppliers, advertising agencies, and the families and persons living in the same household as such employees, are not eligible to participate. The Sweepstakes is subject to all federal, state, and local laws. Void where prohibited or restricted by law or regulations.


How to Enter:

There are two alternative ways to enter:

(1) Visit the Goodwill Store located at 5880 Edinger Ave. Huntington Beach, CA during business hours on Friday September 30 and/or Saturday October 1, 2016. Complete a sweepstakes entry card and drop it off in the provided container.

(2) Send an e-mail entry form to sweepstakes@ocgoodwill.org, no later than 9:00 p.m. on Friday September 30 and/or Saturday October 1, 2016. In the e-mail, include your first and last name, complete address, e-mail address, and daytime telephone number (including area code): E-mails must be time stamped in time to be received prior to expiration of the Sweepstakes Period. Sponsor is not responsible for any delays or failure of mail delivery service.

The Sweepstakes begins each day Friday and Saturday at 9; 00 a.m. Daylight savings Time (“DST”) and ends at 9:00 pm. PST on both September 30 and/or Saturday October 1, 2016 (the “Sweepstakes Period”). Entries received after the Sweepstakes Period will not be eligible. Sponsor will not confirm receipt of entries.


Selection of Winner: One (1) entrant will be selected as the winner on Friday,

September 30 and/or Saturday October 1, 2016 at 9:15 p.m. each day at 5880 Edinger Ave. Huntington Beach, CA, from all entries received at the location as well as by e-mail from the eligible pool of entries by random drawing. The odds of winning depend upon the number of entries received at each location. Limit: one entry per person, Entrants will be disqualified if they submit multiple entries.

The winner will be notified by phone within 24 hours after the Sweepstakes Period ends. The decisions of the Sponsor are final and binding on all matters relating to the Sweepstakes. The winner will be required to sign an affidavit of liability release (except where and to the extent prohibited by law); otherwise the prize will be forfeited, and a new winner will be randomly selected.

Prize (1): The two winners will each receive an iPad. Retail value of prizes: $500 each. All federal, state, and local taxes and all other expenses]] are the sole responsibility of the winner. Prize is nontransferable and may not be substituted or redeemed for cash by winner. SPONSOR MAKES NO WARRANTIES OR GUARANTEES OF ANY KIND REGARDING THE PRIZE, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND THE WINNER SHALL TAKE THE PRIZE “AS IS” AND AT HIS OR HER OWN RISK. Apple, Inc. is not in any way affiliated with or a sponsor of the Sweepstakes.

Release of Liability: By participating, you release Sponsor, and their subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all other associated with the development and execution of this Sweepstakes, from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and you agree that these entities are in no matter responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the Sweepstakes and/or the awarding of any prize.

Additional Rules: By participating in the Sweepstakes, entrant agrees to be bound by these Official Rules, including all eligibility requirements and all decisions of Sponsor, which are final and binding in all matters relating to the Sweepstakes. Disputes: This Sweepstakes shall be governed by and interpreted under the laws of the State of California, U.S.A. without regard to its conflicts of laws provisions. Entrants hereby agree that any and all disputes, claims, causes of action, or controversies (“Claims”) arising out of or in connection with this Sweepstakes or these Official Rules shall be resolved by binding arbitration before a single arbitrator pursuant to this provision and the procedures of JAMS, Inc. (formerly known as Judicial Arbitration and Mediation Services, Inc.) at its offices located in Orange County, CA. NEITHER PARTY WILL HAVE THE RIGHT TO LITIGATE ANY CLAIM IN COURT. FURTHER, NEITHER PARTY WILL HAVE THE RIGHT TO PARTICIPATE IN A REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR OTHER PERSONS SIMILARLY SITUATED, OR AS A MEMBER OF ANY CLASS OF CLAIMANTS PERTAINING TO ANY CLAIM SUBJECT TO ARBITRATION. THE ARBITRATOR’S DECISION WILL BE FINAL AND BINDING. NEITHER PARTY SHALL BE PERMITTED TO OBTAIN AWARDS FOR, AND EACH PARTY HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. The arbitrator’s authority to resolve Claims is limited to Claims between Sponsor and Entrant alone. Furthermore, claims brought by either party against the other may not be joined or consolidated in arbitration with Claims brought by or against any third party, unless agreed to in writing by all parties. No arbitration award or decision will have any preclusive effect as to issues or claims in any dispute with anyone who is not a named party to the arbitration.
